Abdul Hameed Khan and 6 others V. Nasrullah and others,
PLD 2021 Balochistan 59 · Balochistan High Court
This case involved a property dispute in Quetta over land identified as Khasra No. 1226 and related plots. Two separate lawsuits had been filed in the civil court concerning the same property: one by Abdul Hameed Khan and others (the petitioners) seeking declaration, possession, and injunctions against certain defendants, and another by Muhammad Naeem (respondent No. 5) against largely the same parties over the same land.
The defendants in the first suit asked the trial court to consolidate both suits into one proceeding, arguing they involved the same property and overlapping parties. The trial court agreed and merged the cases. The petitioners challenged this through a civil revision petition, which was dismissed, and then approached the Balochistan High Court under its constitutional jurisdiction, asking that the consolidation be undone.
The High Court dismissed the petition and upheld the consolidation. It explained that although the Civil Procedure Code does not explicitly provide for consolidating suits, courts have inherent power to do so when the parties and subject matter overlap, in order to prevent conflicting judgments and promote efficient justice. Relying on Supreme Court precedents, the court held that consolidation is a matter of judicial discretion aimed at avoiding multiple, possibly contradictory rulings on the same dispute, as long as no litigant is prejudiced.
This ruling reaffirms that Pakistani courts can combine related lawsuits over the same property or issue, even without explicit statutory authority, in the interest of judicial efficiency and consistency.
