Ghulam Rasool V. The State,
PLD 2021 Balochistan 55 · Balochistan High Court
This case involved Ghulam Rasool, a Pakistani national who was convicted in Iran in 2015 for possessing 12,512 cans of alcoholic drinks. An Iranian court sentenced him to two years imprisonment plus a massive fine of over 11.6 billion Riyals, with a default penalty of 5,400 additional days in prison if the fine went unpaid. He was later transferred to Pakistan to serve his sentence under a prisoner transfer agreement between Iran and Pakistan, and was held at Central Prison Mach.
Since the huge Iranian fine had no realistic equivalent under Pakistani law, Ghulam Rasool, describing himself as a pauper unable to pay, asked the Balochistan High Court to waive the fine entirely.
The court examined the Transfer of Offenders Ordinance, 2002, and the bilateral transfer agreement, both of which allow a receiving country's courts to adapt a foreign sentence so it matches domestic law, as long as it remains broadly equivalent to the original punishment. Applying Pakistan's own law on intoxicants (the Prohibition Order, 1979), the court converted the sentence to two years imprisonment plus a fine of Rs. 3 lakh, with six months' additional imprisonment if the fine isn't paid. It also ordered that time already spent in custody in Iran be counted toward his sentence.
This case matters because it shows how Pakistani courts handle sentences imposed abroad, ensuring foreign punishments are adjus
