PLD 2021 Balochistan 5 · Balochistan High Court
This case involved a dispute over 5 acres of land in Ziarat, Balochistan. A group of petitioners had applied for allotment of this land under the Land Lease Policy of 1988. Their application was rejected by the Additional Commissioner (Revenue). Rather than fully disclosing what happened with their application, they filed a civil suit asking the court to declare that they were entitled to the land and to stop the government and other parties from interfering with it.
The government and other respondents argued that the petitioners already had a pending appeal against the rejection before the Commissioner, and could not pursue two remedies for the same issue at the same time. They also pointed out that the petitioners had not been fully honest in their court filing about the status of their land application. The trial court agreed and threw out the case, and the appellate court upheld that decision.
The High Court examined a technical but important legal distinction: the difference between "rejecting" a plaint (which allows a person to refile a fresh suit) and "dismissing" a suit (which is a final decision after a full trial, leaving no option to refile). The lower courts had used dismissal, but the High Court found this was actually a case that should be treated as rejection of the plaint. It corrected the record accordingly, but still ruled against the petitioners, and their revision petition was dismissed. This clarifies how courts should classify such decisions and what remedies remain open to litigants.
