PLD 2021 Balochistan 28 · Balochistan High Court

This case involved a dispute over the estate of a deceased police officer, Hussain Ali, and who among several claimants qualified as his legal heirs entitled to a share of his property and pension. His first wife and others applied for a succession certificate, but a woman named Zaib-un-Nisa intervened, claiming she was his third wife and therefore also a legal heir. The trial court and the appellate court both accepted her claim, declared her a legal heir, and divided the estate accordingly among the widows, sons, and daughters. The other heirs challenged this before the Balochistan High Court, arguing that Zaib-un-Nisa had failed to properly prove her marriage and that the courts had wrongly shifted the burden of proof onto them instead of her.

The High Court examined Islamic law principles on marriage, noting that even if a woman remarries before completing her mandatory waiting period (iddat) after a divorce, this makes the marriage merely irregular, not void, and such marriages are not against Islamic law. The court also clarified that proceedings for a succession certificate are meant to be simple and summary in nature. They are not the proper venue for resolving complicated factual disputes about heirship or property title, which should instead go to a civil court through a full trial.

This judgment matters because it clarifies the limited scope of succession certificate proceedings and reaffirms Islamic law principles distinguishing irregular marriages from void ones, protecting the rights of parties in inheritance disputes while directing complex heirship questions to proper civil litigation.
