PLD 2021 Balochistan 211 · Balochistan High Court

This case is about compensation claims for houses destroyed in the 2008 earthquake in District Ziarat, Balochistan. The government had classified earthquake-affected houses into four categories, ranging from totally collapsed (Category A, entitled to Rs. 350,000) to minor damage (Category D, entitled to Rs. 15,000). The plaintiffs claimed their houses were completely destroyed and should be compensated under Category A, but they were left out of the official list of affectees.

A local commission appointed by the court inspected the houses and confirmed they were collapsed and unrepairable. The trial court accepted this and awarded full compensation. However, the appellate court partly overturned this, downgrading some plaintiffs to a lower compensation category based on a survey report the defendants said was conducted by the Army.

The Balochistan High Court restored the trial court's decision. It found that the defendants never produced the original Army survey report or called any Army witness to prove it — they only submitted a photocopy, which has no legal value as evidence unless the original is proven lost. The court reaffirmed that documents must generally be proved through primary evidence, and unproven photocopies or mere statements in a written statement cannot substitute for actual evidence.

This case matters because it reinforces basic evidentiary standards in civil litigation: claims and defenses must be backed by properly proved documents, not unverified copies or unsupported assertions, especially in cases involving public compensation for disaster victims.
