PLD 2021 Balochistan 206 · Balochistan High Court

This case involved a property dispute in Quetta where the respondents claimed ownership of land through a mutation entry and sought possession from the petitioners, who were occupying the property. During the lawsuit, the petitioners asked the trial court to appoint a local commissioner to visit the site and determine who actually possessed the property compared to the ownership map (tatima) presented by the respondents. The trial court agreed and appointed a commissioner, but the respondents challenged this in revision before the District Court, which overturned the trial court's order, saying it was improper to gather such information before evidence was formally recorded.

The Balochistan High Court was asked to review this decision. It ruled that civil courts have broad powers under the law to order local investigations or demarcations to clarify disputed facts, especially in matters involving possession and encroachment, since such issues often cannot be resolved without an on-site inspection. However, the court agreed that at this very early stage of the case, before any issues were framed or evidence recorded, the genuineness of the mutation entries could not be settled merely through a commission's visit, only a full trial with evidence could establish that. The court also clarified that a commission's report is not binding evidence but only assists the judge, and parties may still object to it. Importantly, the court noted the petitioners could reapply for a local commission later, and dismissed the current petition.

بلوچستان ہائی کورٹ سے اس فیصلے پر نظرثانی کی درخواست کی گئی۔ عدالت نے قرار دیا کہ قانون کے تحت دیو
