Sadia Gill V. Vishal Masih and another,
PLD 2021 Balochistan 20 · Balochistan High Court
This case involved a married Christian couple, Sadia Gill and Vishal Masih, whose marriage was breaking down. The husband, Vishal Masih, filed a suit in the Civil Court at Muslim Bagh seeking judicial separation and divorce on the ground that his wife had deserted him. The wife challenged this, arguing that she was now living in Quetta and that the dispute arose there too, so the Muslim Bagh court had no authority to hear the case. She asked for the plaint to be returned so the case could be refiled in Quetta.
The trial court rejected her request, and she challenged that decision before the Balochistan High Court.
The High Court examined the Divorce Act, 1869, which specifically defines which court has jurisdiction in such matrimonial cases: either the court where the husband and wife last resided together, or the court where both currently reside, even if separately. The evidence showed the couple married in Quetta but last lived together in Muslim Bagh, so that location qualified as proper jurisdiction under the first option.
The court also clarified that the general rule under the Civil Procedure Code, which normally allows a suit to be filed where the defendant resides, does not apply when a special law like the Divorce Act already specifies jurisdiction. Special laws override general procedural rules.
The High Court therefore upheld the trial court's decision and dismissed the wife's petition, confirming that Muslim Bagh was the correct venue for the case.
