This case is about a dispute over a shop in Quetta involving a landlord-tenant eviction case that had already gone through the courts, but which affected someone who was never made a party to it.
Baz Muhammad had won an eviction order against Samiullah before the Rent Controller. Samiullah appealed to the High Court, but lost, and that appeal was dismissed in October 2020. However, a third person, Pervez Khan (the applicant here), claimed he was the actual recorded owner of the shop according to revenue records, and that neither Samiullah nor Baz Muhammad had any real connection to the property. Pervez Khan had separately filed and won a civil suit for declaration and permanent injunction regarding his ownership. Crucially, Baz Muhammad knew about this pending suit but concealed it from the High Court while arguing the eviction appeal, and even after the suit was decided in Pervez Khan's favour, still did not inform the High Court.
The High Court held that this concealment amounted to fraud, since fraud vitiates even the most solemn court proceedings. It ruled that Pervez Khan's application under section 12(2) of the Civil Procedure Code (which allows setting aside judgments obtained through fraud or misrepresentation) was valid. The Court set aside the earlier orders, sent the matter back to the Rent Controller with directions to formally include Pervez Khan as a party and decide the case afresh, and imposed Rs. 200,000 in costs on the respondents for hiding material facts.
