Rehmatullah V. Mst. Bibi Zenora and 2 others,

PLD 2021 Balochistan 145 · Balochistan High Court

This case involved a husband, Rehmatullah, challenging a family court decision that favored his wife, Mst. Bibi Zenora. The wife had filed a suit seeking dissolution of her marriage on grounds of cruelty, along with recovery of dower, custody of her children, and return of educational certificates. The Family Court partially granted her requests. The husband then tried to appeal, first before the Member, Majlis-e-Shoora (a local appellate forum), which said it had no jurisdiction, and then before the District and Sessions Judge, who dismissed his appeal for being filed too late.

The Balochistan High Court upheld these decisions. It clarified that under the Family Courts Act, appeals from family court decisions should go to the District Judge, and explained how old Kalat-era judicial structures fit into this framework. It also found the husband's appeal was filed beyond the 30-day limit set by law, with no valid request made to excuse the delay.

On the substance, the court agreed that the wife had proven cruelty, noting evidence of physical and mental mistreatment and the husband's failure to support her for years. The court emphasized that cruelty isn't limited to physical violence and can include emotional harm. It also reaffirmed that the law generally does not allow husbands to appeal dissolution-of-marriage decrees, as this protects wives from prolonged, costly litigation. The petition was dismissed.
