Abdul Kareem V. Sultan Badshah,

PLD 2021 Balochistan 139 · Balochistan High Court

This case involved a money recovery dispute between Abdul Kareem and Sultan Badshah. Sultan Badshah had originally sued Abdul Kareem for recovery of Rs. 8,000,000 based on a negotiable instrument, using a summary procedure under Order XXXVII of the Civil Procedure Code. The trial court initially decreed in the plaintiff's favor, but the High Court reversed this on appeal. The plaintiff then approached the Supreme Court, which sent the case back to the trial court, directing both parties to produce additional evidence about their business dealings, payments made, and account settlements, since the existing evidence on these points was scant.

After the case returned to the trial court, the plaintiff sought permission to submit a ledger document that had not been part of the original case file. The defendant objected, arguing the document was filed late and without proper justification. The trial court allowed the document to be added, and the defendant challenged this decision before the Balochistan High Court.

The High Court upheld the trial court's decision. It explained that the rule governing late submission of documents (Order XIII, Rule 2, CPC) exists to keep out forged or fake documents and to keep trials moving quickly, not to block genuine evidence. If there is no real doubt about a document's authenticity, courts should not reject it just because it was submitted late, especially when it is important for reaching a fair decision. The revision petition was dismissed, meaning the ledger could be used as evidence in the ongoing trial.
