Naseebullah V. The State,

PLD 2021 Balochistan 127 · Balochistan High Court

This case concerns a criminal trial arising from an attack in which a man and his group allegedly injured the complainant's party and damaged property. During the trial, after six prosecution witnesses had already testified, the complainant asked the trial court to allow four additional people to be examined as witnesses, even though they had not been listed in the original calendar of witnesses or had their statements recorded by police during investigation. The trial court allowed this, and the accused's revision petition against that decision was also dismissed by the Additional Sessions Judge. The accused then challenged both orders before the Balochistan High Court.

The High Court dismissed the petition, upholding the lower courts' decisions. It explained that under Section 265-F of the Criminal Procedure Code, courts are legally required to take all evidence offered in support of the prosecution, and there is no rule limiting the prosecution to only those witnesses already named. A witness can be refused only if summoning them would cause unnecessary delay or defeat justice. The court also clarified that failing to record a witness's statement during police investigation does not bar that person from later testifying at trial, for either side. This ruling reinforces that trial courts have limited grounds to refuse witness testimony and that technical omissions during investigation do not automatically exclude relevant evidence from being heard.
