PLD 2021 Balochistan 116 · Balochistan High Court

The case concerned a small cabin or khokha in Pishin, Balochistan. The petitioner claimed ownership, saying his father had purchased the property, and he sought a court declaration of ownership, cancellation of a mutation and a Deputy Commissioner's order in favor of another party, and a permanent injunction against transfer of the property. Both the trial court and the appellate court dismissed his suit, finding he failed to prove his claim. He then approached the Balochistan High Court through a civil revision petition.

The High Court upheld the lower courts' decisions. It held that simply attaching a sale deed to the plaint does not prove that the document was validly executed. Under Article 79 of the Qanun-e-Shahadat, a document requiring attestation must be proved by producing at least two attesting witnesses; without this, the document cannot be treated as legally proved. Since the petitioner failed to produce any attesting witness to the alleged sale deed, or explain why they couldn't be produced, he failed to discharge the burden of proof resting on him as the plaintiff. The Court explained that this witness requirement exists to prevent fraud and fabricated evidence.

Because both lower courts had reached the same factual conclusion and no legal error was shown, the High Court declined to interfere and dismissed the revision petition. The case highlights the strict evidentiary standard required to prove property documents in Pakistani courts.
