Abdul Mateen through guardian/father V. Bibi Khadija and others ,
PLD 2021 Balochistan 113 · Balochistan High Court
This case was about a request to correct what the petitioner claimed was a clerical mistake in a civil court judgment. In 2015, a trial court in Quetta decided a suit filed by Abdul Mateen (through his father) regarding an injunction over a shared wall between shops. In its judgment, while deciding one of the legal issues, the trial court referred to an earlier ruling (from a separate eviction case) that had gone in favour of the "defendants." The petitioner argued that this word should actually have read "plaintiff," and that it was simply a typing or clerical slip, asking the court to fix it under Section 152 of the Civil Procedure Code, a provision meant for correcting minor clerical or arithmetical errors.
The trial court rejected this request, finding that the wording was not a mistake at all, but reflected the actual outcome of the earlier litigation between the parties, which had indeed favored the respondents. This rejection was upheld in a subsequent revision petition, leading to the present case before the Balochistan High Court.
The High Court dismissed the petition, explaining that Section 152 can only be used to fix genuine accidental or clerical errors that are obvious on their face. It cannot be used to reopen or change a court's deliberate findings or correct what a party feels is an unfair or wrong decision. Since the trial court had used the word "defendant" deliberately and correctly, there was nothing to correct, and the petition was dismissed.
