PLD 2021 Balochistan 105 · Balochistan High Court

This case is about farmers near Quetta who had, for generations, irrigated their crops using untreated sewage (black/grey) water flowing through the Nohsar channel. Earlier, in 2014, the court had allowed them to continue this practice on condition that the sewage water be diluted with purified water at a fixed ratio. When authorities later blocked the channel at several points, cutting off water to about 1,000 acres, the farmers went back to court, arguing this violated their fundamental right under Article 18 of the Constitution to freely carry on their trade and livelihood.

The Balochistan High Court examined official reports showing the "sewage" water actually contained hazardous waste from households, hospitals, and factories. Crops, especially leafy vegetables, grown with this contaminated water were absorbing toxic chemicals and metals, posing serious health risks to consumers in the local market. The court held that while Article 18 protects freedom of trade and business, this right only extends to lawful business, not one that endangers public health. It ruled that cultivating crops with contaminated sewage water is an unlawful business and directed authorities to stop it, relying on the earlier Shehla Zia case on environmental rights.

The judgment matters because it shows courts can use their constitutional powers to protect public health and safety, even when this restricts an economic activity that people have depended on for their livelihood.
