PLD 2020 Balochistan 5 · Balochistan High Court

This case was about a family property dispute. After Karam Khan died in 1980, his descendants through his daughters claimed a share of his property through a suit for declaration, partition, possession and other relief. The defendants disputed that these women were actually Karam Khan's daughters.

During the trial, the plaintiffs asked the court to let them produce official family registration records (RTC forms) through NADRA to prove the disputed family relationship, even though these documents had not been filed earlier in the case. The trial court refused, but on appeal the Additional District Judge partly allowed the request, letting the plaintiffs obtain these records through NADRA, while rejecting a related request about calling additional witnesses. The defendants then challenged this appellate decision before the High Court.

The High Court upheld the appellate court's order and dismissed the petition. It explained that the legal requirement of showing "good cause" for late production of documents under the Civil Procedure Code should be interpreted liberally, in the interest of justice, rather than used to punish parties for technical delays. Since there was no fraud or doubt about the authenticity of the NADRA documents, and such records are public documents presumed genuine, they could be allowed in as evidence. The court also clarified that someone who merely produces a document in response to a court summons does not thereby become a witness.

This ruling is significant because it clarifies how courts should balance procedural strictness with fairness when parties seek to introduce important evidence, especially genuine public records, later in a trial.
