Muhammad Khan Kurd V. Arbab Muhammad Hashim,

PLD 2020 Balochistan 38 · Balochistan High Court

This case involved a man who sued for 3 crore rupees in damages, claiming he had been maliciously prosecuted. Years earlier, the respondent had an FIR registered against the appellant and others for allegedly occupying property through fraud, breaking walls, and illegal possession. The criminal court framed charges, but after only two witnesses were examined, the appellant was discharged under section 249-A Cr.P.C. He then filed a civil suit claiming this prosecution was malicious and damaged his reputation. The trial court rejected his plaint, and he appealed.

The Balochistan High Court upheld the dismissal. It explained that to win a malicious prosecution case, a plaintiff must prove the prosecution was based on malice and lacked any reasonable or probable cause, and that it ended in his favor. Here, a related civil property dispute was already pending between the parties, showing there was a genuine basis for the complaint. The court also noted an important legal distinction: the appellant was "discharged," not "acquitted" on merits -- his case ended on a technical ground, not because he was found innocent. Additionally, the suit was filed four years after the criminal case ended, far beyond the one-year limitation period for such claims under the Limitation Act. Since the suit was both legally unfounded and time-barred, the appeal was dismissed, confirming the original judgment.

بلوچستان ہائی کورٹ نے اس مسترد کرنے کے فیصلے کو برقرار رکھا۔ عدالت نے وضاحت کی کہ بدنیتی پر مبنی مقدمہ باز
