The State through District and Sessions Judge, Kalat V. Assistant Commissioner and others,
PLD 2020 Balochistan 26 · Balochistan High Court
This case arose after an Assistant Commissioner, during a raid, arrested a Qazi (a judicial officer) and then had him dragged, manhandled, and beaten in public view. This caused outrage across the judiciary in Balochistan, with judicial officers feeling humiliated and insecure, and several Bar Associations going on strike in protest. The matter was treated as a contempt of court case under the Contempt of Court Ordinance, 2003, because such treatment of a judicial officer was seen as an attack on the dignity and authority of the courts themselves.
The Balochistan High Court held that while judicial officers are not above the law and can be lawfully arrested like any citizen, the manner of this arrest—public humiliation and physical assault—went far beyond a mere procedural arrest and amounted to a deliberate attempt to undermine the judiciary. The court found the Assistant Commissioner guilty of contempt but took a lenient view because he had tendered an unconditional apology early on, sentencing him to a nominal fine and token imprisonment till the rising of the court.
Importantly, the court laid down detailed guidelines for how judicial officers must be arrested in the future—such as prior intimation to the District Judge or High Court, no handcuffing except in genuine emergencies, and safeguards during any arrest—to protect the judiciary's independence while still upholding equality before the law.
