PLD 2020 Balochistan 21 · Balochistan High Court
This case involved a dispute between construction contractors and the Balochistan government over a tender for school construction work. The petitioners, who are registered government contractors, had submitted bids in response to a public tender notice in May 2019. They claimed that when the time came to open the tenders in June, the authorities did not open them publicly as promised. Instead, they alleged the contract was secretly awarded to another contractor of the authority's choosing, without proper explanation or transparency, in violation of public procurement rules.
The contractors approached the Balochistan High Court asking it to declare the award illegal, cancel the rival contractor's work order, and allow them a fair chance to compete for the tender.
The government side argued that proper procedures had actually been followed, that other contractors did participate in the bidding process, and that the petition involved disputed facts not suitable for this type of court proceeding.
The High Court agreed with the government's position on procedure. It held that the case involved serious factual disputes - particularly around the authenticity of documents submitted by both sides - that could not be resolved through the court's constitutional jurisdiction, which is meant for clear-cut legal violations, not detailed factual investigations. Such disputes, the court said, require a full civil trial with evidence and cross-examination. Since an alternate remedy (a civil suit) was available, the constitutional petition was dismissed as not maintainable. This case illustrates the limits of High Courts' constitutional powers when genuine factual disputes exist.
