This case involved Bashir Ahmed, a government official who served as District Food Controller and Incharge of a wheat storage facility (godown) in Quetta. The National Accountability Bureau (NAB) began investigating him over allegations of misappropriation and wastage of stored wheat, after a large shortage and damage to wheat stocks was discovered. Facing possible arrest, Ahmed asked the Balochistan High Court for pre-arrest bail.
The record showed that the godown had capacity for only 238,000 bags, yet over 514,000 bags had been stored there, many left out in the open due to lack of space. Ahmed had repeatedly written to his superiors warning about deterioration, insect damage, and the need for fumigation and repairs, but his warnings went unheeded. An earlier government inquiry had already cleared him, finding the losses were due to overstorage, weather, and poor conditions rather than his wrongdoing.
The High Court found that singling out Ahmed, a lower-grade official, while higher officials who ignored his warnings faced no scrutiny, appeared unfair and suggested he was being made a scapegoat. Since he had cooperated with NAB and the allegations needed further investigation, the court granted him pre-arrest bail, while directing him to continue cooperating with the inquiry.
This case matters because it highlights how accountability proceedings can unfairly target junior employees while shielding senior officials, and shows courts using bail powers to prevent such unjust targeting.
