Arsala V. Special Judge, Anti-Terrorism Court and another ,
PLD 2020 Balochistan 100 · Balochistan High Court
This case involved a man named Arsala who had originally been sentenced to death for murder under Pakistan's Anti-Terrorism Act. After appeals, the Supreme Court acquitted him of the murder charge but upheld his conviction under the terrorism law, reducing his sentence to life imprisonment with a fine. Once in prison, he asked for the benefit of special remissions (sentence reductions) that the government routinely grants to other prisoners, plus credit for time already spent in custody before trial. Prison authorities refused, citing Section 21-F of the Anti-Terrorism Act, which specifically bars remissions for anyone convicted under that law, except children.
The Balochistan High Court ruled in Arsala's favor. It held that the Constitution's Article 25 guarantees equality before the law and equal protection for all citizens, including prisoners. The court reasoned that while different laws may set different courts or harsher punishments, once someone is convicted, they should be treated like any other prisoner under prison rules. Denying remissions only to those convicted under anti-terrorism law, while granting them to others, amounted to unfair discrimination with no reasonable justification. Relying on earlier rulings from Balochistan, Lahore, and Sindh High Courts, the court found Section 21-F's blanket denial of remissions unconstitutional as applied here, and ordered authorities to give Arsala all remissions he had been denied. The case reinforces that constitutional equality rights extend to how prisoners are treated, regardless of which law they were convicted under.
