PLD 2020 Balochistan 10 · Balochistan High Court

This case involved a 17-year-old inquiry by the National Accountability Bureau (NAB) against officials of Pakistan State Oil. NAB began investigating the respondents in 2002 but found no evidence, so the case was formally closed in 2005 by the Accountability Court. Years later, in 2009, NAB sought permission to reopen the investigation, which the trial court initially granted. The High Court set that order aside and sent the matter back for a fresh decision. In 2019, the Accountability Court again refused to allow reinvestigation, prompting NAB to challenge that refusal before the Balochistan High Court.

The High Court dismissed NAB's petition, ruling that while agencies can seek reinvestigation after closing a case, this is only permitted if genuinely new evidence has emerged that was not available earlier. NAB must approach the relevant court and justify the need for reinvestigation; the court should not simply rubber-stamp the request. The judges emphasized key differences between ordinary police investigations and NAB investigations, noting NAB has far greater resources and time, so closure of a NAB case effectively amounts to a "clean chit" for the accused.

In this case, the accused had already endured 17 years of inquiry and investigation, with some even dying during the process. The court held that prolonging proceedings further, without new evidence, would be an abuse of process. This ruling reinforces protections against indefinite harassment of citizens under accountability laws and clarifies the legal standard required before reopening closed investigations.
