Chairman, NAB through Prosecutor General V. Munawar Masih and another,

PLD 2020 Balochistan 1 · Balochistan High Court

This case involved Munawar Masih, a former postmaster accused of misappropriating over Rs. 14 lakh in money order funds. After years as a fugitive, he was eventually brought to trial before the Accountability Court in Quetta under the National Accountability Ordinance, 1999. During trial, he applied for acquittal under Section 265-K of the Criminal Procedure Code, arguing he had repaid the misappropriated amount. The trial court, however, treated this application as a plea bargain request and approved it, releasing him on that basis.

The Chairman of NAB challenged this before the Balochistan High Court, arguing the trial court had acted improperly. The High Court agreed. It explained that under Section 25(b) of the NAB Ordinance, only the Chairman of NAB has the power to negotiate and approve a plea bargain, including deciding how much money the accused must return. Courts can only approve or reject a plea bargain already arranged by NAB, not create one on their own. Since the accused never applied for a plea bargain through NAB, and the Chairman NAB never approved any deal, the trial court had no authority to invent one and fix the liability itself.

The High Court set aside the trial court's order and sent the case back to the stage before the irregular conversion occurred.

This ruling matters because it reinforces that procedures laid down by law must be strictly followed, and reaffirms that only NAB's Chairman—not courts—can authorize plea bargains in corruption cases, preserving the intended checks against misuse of this process.
