PLD 2019 Balochistan 27 · Balochistan High Court
This case involved a media company, Independent Media Corporation (owner of Geo News), its executives, and hosts of a current affairs show called Aaps Ki Baat. After the program discussed a news report about land allotted to a former army chief, multiple criminal cases (FIRs) were filed against them across Pakistan, including eight in Balochistan, all based on the same broadcast and containing nearly identical allegations of anti-state content.
The petitioners argued that since Pakistan's media regulator (PEMRA) had already fined them for violating licence conditions over the same broadcast, no separate criminal case should proceed. They also argued that having to defend themselves in numerous FIRs across different cities for the same incident was unfair, illogical, and violated their constitutional rights.
The Balochistan High Court rejected the argument that PEMRA's fine barred criminal prosecution, since the regulator only dealt with licence violations, not criminal liability. However, the Court agreed that filing multiple FIRs for a single incident was improper. It ruled that only the first FIR (registered in Karachi) should proceed to trial, while the other FIRs should be treated merely as witness statements under the law and quashed.
This matters because it reinforces the legal principle that one incident should result in only one FIR, protecting accused persons from being harassed through duplicate prosecutions in different courts, which the Court found to be an abuse of legal process and inconsistent with constitutional guarantees of fairness and due process.
