PLD 2019 Balochistan 106 · Balochistan High Court

This case from the Balochistan High Court dealt with a civil suit that had been dismissed by a trial court for "non-prosecution" after the plaintiffs failed to appear on a hearing date. The twist was that the date in question had not been fixed by the judge himself, but by the court reader (clerk), after the judge was on leave. The plaintiffs' later attempts to have the suit restored were also rejected by the trial court and the appellate court, leading them to approach the High Court.

The High Court ruled in favor of the petitioners on several grounds. First, it held that a date adjourned merely by a court reader's note, rather than by the presiding judge, does not count as a proper "date of hearing" under the law, making the dismissal order invalid from the start. Second, since the case had already finished trial and was fixed only for final arguments, the correct legal procedure (under Order XVII, Rule 3 of the Civil Procedure Code) required the court to either decide the case on available evidence or reschedule arguments—not dismiss it outright. Third, the restoration application was filed within the proper three-year limitation period, so it wasn't time-barred.

The Court set aside the lower courts' orders, restored the suit, and sent it back for a fresh decision on merits. The judgment is significant because it protects litigants from losing years of litigation effort due to procedural technicalities and clerical errors rather than substantive issues.
