Dawood Khan and another V. Sultan Muhammad,
PLD 2019 113 · Balochistan High Court
Dawood Khan and another challenged a decision of a Rent Controller in Quetta who had thrown out their eviction case against their tenant, Sultan Muhammad. The dispute involved a shop that had originally been rented out by one family member. After the original landlord died, the shop passed to his heirs through inheritance, and the new owners sought to evict the tenant, both for non-payment of rent and because they wanted to use the shop themselves. The tenant argued there was no landlord-tenant relationship between him and the new owners, claiming he had actually bought the shop from a third party who had earlier purchased it from a relative of the landlords. The Rent Controller sided with the tenant, ruling that the new owners had failed to prove they were his landlords, and dismissed the case entirely.
The Balochistan High Court disagreed. It found that the tenant had originally been inducted into the shop by a relative of the new owners, and that ownership had since passed to the new owners through a proper inheritance mutation. The court held that simply denying the landlord-tenant relationship does not change a tenant's legal status, and that a co-owner is fully entitled to file an eviction case. Because the tenant's denial was found to be deliberate and unjustified, the court ruled he must vacate the shop immediately and pay three years of unpaid rent, with any further arrears to be pursued separately in civil court. The appeal was allowed, reversing the Rent Controller's decision.
