Lal Bakhsh and another V. The State,
PLD 2018 Balochistan 97 · Balochistan High Court
This case involved two men, Lal Bakhsh and others, who were tried and convicted by an Anti-Terrorism Court in Mekran, Turbat, for the brutal killing of a young man and woman, Jalal and Maryam. The killings arose from a so-called honour crime: Maryam's family disapproved of her relationship with Jalal, and after luring both to their home under the pretext of arranging a marriage (Nikkah), several family members attacked and slaughtered them. The trial court had sentenced one accused to life imprisonment and others to death, treating the killings as an act of terrorism under the Anti-Terrorism Act.
On appeal, the defense argued that this was actually a private family matter, not terrorism, and should have been tried by an ordinary criminal court rather than a special anti-terrorism court. The Balochistan High Court agreed. Relying on a Supreme Court ruling in Khuda-e-Noor v. The State, the High Court held that honour killings, even when committed violently, are private offences carried out for personal motives within the privacy of a home, and therefore do not meet the legal definition of "terrorism." As such, the Anti-Terrorism Court had no jurisdiction to try the case.
Without examining whether the accused were actually guilty, the High Court set aside the conviction and sentence and sent the case back to be tried afresh by the ordinary courts. This decision clarifies that honour killings, regardless of their brutality, fall under ordinary criminal law rather than anti-terrorism law.
