PLD 2018 Balochistan 91 · Balochistan High Court

This case involved a man who had acted as a surety for an accused person to secure his bail. When the accused failed to appear in court, the trial court forfeited the surety bond and ordered the petitioner to pay the amount. When he didn't pay, the trial court directed the government department where he worked to stop his salary and deduct the forfeited amount directly from it. The petitioner challenged this in the Balochistan High Court.

The High Court examined Section 514 of the Criminal Procedure Code, which governs how courts can recover forfeited bond amounts, typically by attaching and selling a person's movable property. The court looked at how movable property is defined under Section 22 of the Pakistan Penal Code and found it covers tangible property that can be seen and taken possession of, not future income that has not yet been earned. Since unearned salary does not qualify as movable property, the court ruled that the trial court had no legal authority to order the attachment of the petitioner's future salary.

However, the High Court also found that the petitioner had been given multiple chances to pay in installments and had failed to do so, and that his petition concealed relevant facts. So the court did not reduce the forfeited amount further or allow fresh installments. Instead, it set aside only the salary attachment order and directed the trial court to recover the money through the proper legal procedure, such as attaching physical property or, if necessary, imprisonment. This clarifies limits on how courts can enforce bond forfeitures.
