Muhammad Abdul Qadir V. Provincial Election Commissioner, Balochistan and 2 others,

PLD 2018 Balochistan 59 · Balochistan High Court

This case concerns a challenge to the rejection of a candidate's nomination papers for the 2018 Senate elections in Balochistan, specifically for a seat reserved for 'technocrats.'

Muhammad Abdul Qadir wanted to contest as a technocrat candidate. His nomination was rejected by the Provincial Election Commissioner, and an appeal tribunal upheld that rejection, ruling he did not qualify as a technocrat under the Elections Act, 2017.

The petitioner held a Bachelor of Arts and an LLB degree, and argued this gave him roughly seventeen years of education. For experience, he pointed to over a decade running an automobile and construction supply business. He argued the law's definition of technocrat did not require his professional experience to match his field of education, and that his legal training was, in any case, relevant to his business dealings.

The Balochistan High Court disagreed. It held that under Section 2(xxxix) of the Elections Act, 2017, a technocrat candidate must satisfy two conditions together: a degree requiring at least sixteen years of education recognized by the Higher Education Commission, and twenty years of experience with a record of achievement—crucially, experience connected to the same field as the academic qualification. Since the petitioner's law degree had no real connection to his business of supplying vehicles and construction work, he did not meet this definition. The court therefore dismissed his petition, confirming the rejection of his nomination papers.

This ruling matters because it clarifies that Senate seats reserved for technocrats are meant
