This is an explainer of a Balochistan High Court decision from 2017 involving a custody dispute over a minor child named Hamadan.
A Family Court had earlier granted custody of the child to his father, Aminullah Mandokhail, while allowing the mother visitation rights. Since neither parent appealed, that decision became final. When the father tried to enforce the custody order through execution proceedings, the mother avoided producing the child despite being summoned and having given an undertaking to do so. Concerned that the mother had resigned from her job and might take the child abroad, the father approached the High Court directly, asking it to order the child's recovery and to have his name placed on the Exit Control List to prevent him from leaving the country.
The High Court declined to intervene directly. It held that the father already had adequate remedies available under existing law—specifically the Family Courts Act, 1964 and the Guardians and Wards Act, 1890. The court explained that the Family Court, acting as the executing court, already had full power under Section 25 of the Guardians and Wards Act to arrest the child and hand him over to the father, using powers similar to those given to magistrates under the Criminal Procedure Code. It could also penalize the mother for non-compliance under Section 45, and could order the child's name placed on the Exit Control List if needed.
Since an effective legal remedy already existed at the trial court level, the High Court refused to use its special constitutional powers and directed the father to pursue enforcement through the executing court instead. This case illustrates that courts encourage parties to exhaust ordinary legal
