PLD 2017 Balochistan 61 · Balochistan High Court
This case explains which court has the power to hear a challenge to a judgment when the challenge is based on fraud or misrepresentation under Section 12(2) of the Civil Procedure Code.
A trial court (Qazi Lasbela) had issued a judgment in 2009, which was then challenged in appeal and upheld on its merits by the appellate court (Majlis-e-Shoora) in January 2010. Later, one party filed an application under Section 12(2) CPC before the original trial court, alleging the 2009 judgment was obtained through fraud. The trial court agreed and set aside its own earlier judgment. However, the appellate court overturned this, ruling that since it had already affirmed the judgment on its merits, any fraud-based challenge should have been filed with the appellate court, not the trial court.
The High Court upheld the appellate court's decision. It clarified that under Section 12(2), such applications must go to whichever court issued the "final" judgment, meaning the last court that actually examined the case on its merits (facts and law). If a higher court confirms a lower court's decision after fully reviewing it, the lower court's judgment merges into the higher court's ruling, which then becomes the proper forum for any fraud challenge. Since the petitioners filed in the wrong court, their revision petition was dismissed.
This case matters because it clarifies procedural rules about which court has jurisdiction to reopen a judgment alleged to be tainted by fraud, preventing confusion when judgments pass through multiple levels of appeal.
