Quetta Metropolitan Corporation through Administrator, Quetta and 2 others V. Abdul Wasay and others,

PLD 2017 Balochistan 37 · Balochistan High Court

The Quetta Metropolitan Corporation (QMC) had leased out shops to several tenants over decades. After the lease terms expired, the tenants continued paying rent monthly, but QMC decided to raise rents significantly and asked tenants to sign new agreements at the higher rates. The tenants sued, claiming the increase was arbitrary and that QMC should have gone through the Rent Controller under rent-control law instead of unilaterally raising rents. Two lower courts agreed with the tenants and ruled against QMC.

QMC challenged these rulings before the Balochistan High Court. The High Court found that government notifications specifically exempted properties belonging to local bodies like municipal corporations from the Urban Rent Restriction Ordinance when used for shops or commercial purposes. It held that QMC, as a public body, had the right to manage its properties, set rents according to market rates, and increase rent to reflect fair value especially since tenants had occupied the shops for around 50 years while paying very low rent. The court ruled that such decisions by public authorities could only be challenged if they were arbitrary, discriminatory, or made in bad faith, none of which was shown here.

The court set aside the lower courts' decisions, ruling in favor of QMC's right to enhance rent, while allowing tenants to keep their shops if they paid the new rates; otherwise, QMC could pursue eviction. This case clarifies that public bodies have broad authority to manage and monetize their properties in the public interest.
