Bibi Humera V. Ghulam Dastagir and 3 others,

PLD 2017 Balochistan 22 · Balochistan High Court

This case involved a widow, Bibi Humera, whose husband, a government employee, died in the line of duty in 2011 and was declared "Shaheed." The government awarded compensation of two million rupees plus his monthly salary and pension benefits, meant for his widow and five children. A succession certificate was obtained by the deceased's brother, who then collected the compensation and salary, allegedly keeping most of it for himself and refusing to hand over the minor children or their share of the money to the widow. She approached the Balochistan High Court seeking custody of her children, return of the money, and protection.

During proceedings, custody of two of the five children was restored to the mother, while the older children preferred to stay with relatives. The Deputy Commissioner's office began paying school fees directly to the children's institutions to prevent misuse of funds. The court found that the brother-in-law, though granted the succession certificate as an attorney for the widow and children, was legally bound to properly distribute the funds under Section 375 of the Succession Act, 1925. It sent the matter back to the court that issued the certificate, directing it to recover the minors' shares from him. Regarding custody, the court held that since alternate remedies existed under the Family Courts Act, 1964, the mother should pursue custody through the family courts rather than through a constitutional petition. This case highlights the importance of protecting vulnerable widows and children from financial exploitation by relatives.
