Abdul Rahim and another V. Chief Secretary Balochistan, Government of Balochistan and 2 others,
PLD 2017 Balochistan 105 · Balochistan High Court
The case involved two contractors, Abdul Rahim and another person, who had been awarded a government contract to build a 10-kilometer road in Balochistan. They claimed that during construction, militants attacked their workers and machinery with rockets, kidnapped their laborers, and forced them to pay ransom, ultimately halting the project. They sued the Balochistan government for over 14 million rupees in damages, arguing the government had assured them it would cover such losses.
The trial court dismissed their suit, and they appealed to the Balochistan High Court. The appellants argued the lower court had ignored their evidence and misapplied the law, including a provision they said meant the government had already admitted their claim.
The High Court disagreed. It found that the contractors could not go beyond the terms of the contract they had voluntarily signed, and that any law-and-order problems should have been addressed through local administration rather than by suing the government for damages outside the contract's scope. The court also noted the plaintiffs failed to prove their claims with credible evidence and had withheld important facts about the actual contract awarded. Notably, the appellants and their lawyer had stopped appearing in court for over a year, suggesting delay tactics.
The court upheld the trial court's dismissal, ruling that contractors cannot claim damages beyond what their contract allows, especially without solid proof and honest disclosure to the court.
