PLJ 2018 Lahore 606

PLD 2016 Supreme Court 613), · Supreme Court of Pakistan

This case involved a family dispute over maintenance allowance and recovery of gold ornaments. A wife and her two minor children had filed a suit against the husband, claiming monthly maintenance and the return of gold ornaments allegedly taken from her. The Family Court at Depalpur partly granted the claim, awarding maintenance only to the two children but rejecting the wife's personal claims. On appeal, the Additional District Judge overturned this entirely, ruling that the Depalpur court had no jurisdiction to hear the case in the first place, since evidence showed the wife was actually residing with her parents in Lahore, not Depalpur as claimed in the suit. The appellate court dismissed the whole suit, though it allowed the family to refile in the correct court.

The wife then challenged this dismissal before the Lahore High Court through a constitutional petition, arguing that she did reside in Depalpur and that court had jurisdiction.

The High Court examined the law on jurisdiction under the Family Courts Act, 1964, noting that a person can be deemed to reside at more than one place if they have both a permanent and temporary residence, and that even a short period of residence can establish jurisdiction for a wife's convenience. This principle is important because family law cases often hinge on where the wife or family actually lives, and the ruling reinforces that such jurisdictional rules are meant to protect the convenience of wives seeking maintenance.
