PLD 2016 Balochistan 76 · Balochistan High Court

This case is about a dispute between a landlord and a tenant over a shop in Quetta. The landlords sought the tenant's eviction, claiming he had defaulted on rent payments from 2007 to 2013 and that the shop was needed for the personal use of two of the landlords' family members who were unemployed. The tenant argued he had not defaulted, that he had deposited rent with the local Bazar Union, and that the landlords were acting in bad faith since they had other shops available.

The Rent Controller in Mastung ruled in favor of the landlords, ordering the tenant to vacate the shop. The tenant appealed to the Balochistan High Court.

The High Court upheld the eviction order. It held that a landlord's sworn statement about needing the property for personal use is sufficient evidence to justify eviction, and a statement made through an attorney counts the same as one made by the landlord personally. The fact that the family members who needed the shop didn't personally testify did not undermine the landlords' case. The court also found that the tenant had failed to pay the legally required periodic rent increases, which amounted to wilful default, making him liable for eviction even though he later paid the arrears. The landlord was also found to have the right to choose which of his properties to reclaim for personal use. The tenant was given six months to vacate while continuing to pay rent, and the appeal was dismissed.
