Syed Atiq Anwar Sherazi V Director General, National Accountability Bureau, Balochistan,

PLD 2016 Balochistan 69 · Balochistan High Court

This case began as a bail petition by Syed Atiq Anwar Sherazi, who was under investigation by the National Accountability Bureau (NAB) in Balochistan. During the case, he and NAB reached a plea bargain under section 25 of the National Accountability Ordinance, 1999, and he agreed to pay Rs. 7.732 million. NAB informed the court that it had received this amount but planned to deduct 25 percent as its own share, based on a Federal Finance Ministry letter from 2000.

The High Court examined whether NAB or the Federal Government had any legal authority to keep a cut of recovered money. It found that neither the Constitution nor the NAB Ordinance permitted such deductions. Any collection or retention of money from the public must be backed by an actual law passed by Parliament or a Provincial Government, not just an administrative letter or internal procedure. The Finance Ministry's instructions allowing NAB to keep 25 percent had no legal backing and violated Article 77 of the Constitution, which deals with how public money is handled.
