Dr. Asadullah Khan Tareen V. Government of Balochistan Health Department and another,

PLD 2016 Balochistan 56 · Balochistan High Court

This case involved a civil servant, Dr. Asadullah Khan Tareen, who approached the Balochistan High Court through a constitutional petition seeking implementation of a judgment previously passed in his favour by the Service Tribunal, in a dispute connected to his employment terms with the Government of Balochistan's Health Department.

The core legal question was whether the High Court had jurisdiction to order implementation of a Service Tribunal's judgment. The Court held that it did not have this power. It explained that under the Constitution, the High Court's authority is limited to what is specifically granted to it by the Constitution or by law, and matters concerning the terms and conditions of civil servants' service fall exclusively within the domain of Service Tribunals, not ordinary courts. The Service Tribunal itself functions like a civil court and has full power, including under the Code of Civil Procedure, to enforce its own orders if they are disobeyed. The High Court's constitutional jurisdiction is meant to address questions of law, not to resolve factual disputes or enforce another tribunal's rulings.

The Court also discussed the importance of respecting separation of powers among the legislature, executive, and judiciary, and noted that while government authorities must promptly comply with Tribunal judgments or appeal them, that process falls outside the High Court's constitutional jurisdiction.

As a result, the petition was dismissed. The case reinforces that civil servants must seek enforcement of Service Tribunal decisions through proper channels, not through the High Court's constitutional powers.
