Suleman Mehmood V. Anwari Begum and others,
PLD 2016 Balochistan 39 · Balochistan High Court
This case is about a legal dispute over which court had the authority to handle a deceased person's estate. Suleman Mehmood applied to a civil court in Quetta for a letter of administration, so he could manage the immoveable properties left behind by his late brother, Saqib Mashhood. The deceased had lived in Quetta, but his properties were located in different districts of Punjab (Sialkot, Multan and Sargodha). The trial court in Quetta refused to hear the case, saying it had no jurisdiction because the properties were outside its territorial limits, and returned the application.
Suleman appealed. The Balochistan High Court examined the relevant provisions of the Succession Act, 1925, particularly Sections 264 and 270 (which deal with jurisdiction for letters of administration) as opposed to Section 371 (which applies specifically to succession certificates). The High Court clarified that both the court where the deceased ordinarily resided and the court where the properties are located can have jurisdiction to grant a letter of administration. Since the deceased resided in Quetta, that court also had jurisdiction, and it was wrong to reject the application without properly examining the law.
The High Court set aside the trial court's order and sent the case back for a fresh decision. The judgment matters because it clarifies which courts can handle estate administration when the deceased's residence and property locations differ, ensuring people aren't wrongly denied access to the correct forum.
