PLD 2016 Balochistan 21 · Balochistan High Court

This case concerned a restaurant owner in Quetta who offered sheesha (water pipe) smoking to customers alongside his regular food business. The Balochistan government had issued an order in August 2014 banning sheesha at public places including restaurants, hotels, fast food centers, net cafes, and sheesha cafes. The petitioner was earlier charged over this but got acquitted in the criminal case. He then challenged the government's ban itself, arguing that tobacco used in sheesha was legally imported and available in the open market, that smoking sheesha wasn't defined as an offence under any law, and that the government had no legal authority to stop his lawful business, which he said violated his constitutional right under Article 18 to freely conduct trade and business.

The Balochistan High Court rejected his petition. It held that offering sheesha smoking violated the Prohibition of Smoking and Protection of Non-Smokers Health Ordinance, 2002, and that the legal importation of tobacco did not make its use in this manner lawful. The court also found that the provincial government's restraining order was validly issued under Section 144(6) of the Criminal Procedure Code, which specifically empowers provincial governments to issue such orders. Since Article 18 protects only lawful trade and business, and the petitioner's sheesha service was not lawful, no fundamental right had been violated. The petition was dismissed, meaning the ban on sheesha smoking at public places stood, reinforcing public health regulation over business claims.
