PLD 2015 Balochistan 97 · Balochistan High Court
This case concerned Rule 12 of the Balochistan Civil Servants (Appointment, Promotion and Transfer) Rules, 2009, which reserved certain government jobs specifically for the widows or children of civil servants who had died while in service. Employees and petitioners challenged this rule before the Balochistan High Court, along with related contempt and other connected petitions, arguing that reserving posts for a specific privileged category of citizens was unfair and unconstitutional.
The court held that while classification of citizens for legitimate purposes is not automatically forbidden, any such classification must have a reasonable connection to the goal being pursued. Since the object of government recruitment is to secure the best available talent through merit, reserving posts for relatives of deceased civil servants had no logical link to that goal. The court found this arrangement discriminatory, saying it unfairly advantaged one class of widows and children over others in society, could result in less qualified candidates being appointed over better qualified ones, and risked creating an impression that government jobs were hereditary.
The court ruled that Rule 12 violated the constitutional guarantees of equality, non-discrimination, and the right to pursue lawful occupations through open, transparent competition. It declared the rule unconstitutional and directed the government to reconsider such discriminatory reservations. The judgment matters because it reinforces that public employment must be merit-based and open to all citizens equally, rather than reserved for favored groups.
