PLD 2015 Balochistan 69 · Balochistan High Court
This case challenged two old laws still applied in parts of Balochistan: the Dastoor-ul-Amal Diwani, Riasat Kalat, 1952 (a civil dispute-resolution code from the former Kalat State) and the Balochistan Civil Disputes (Shariat Application) Regulation, 1976. The petitioners argued these laws were outdated, discriminatory, and legally dead—claiming the Dastoor had already been repealed by the West Pakistan Civil Courts Ordinance, 1962, and that the provincial government had no power to revive it or exempt certain areas from the 1962 Ordinance in its favor. They also argued the Regulation was flawed because it didn't specify a forum for non-Muslims and barred private citizens from filing claims against government bodies.
The Balochistan High Court dismissed the petition. It traced the complicated legislative history and found that the 1962 Ordinance's schedule, which supposedly repealed the Dastoor, conflicted with the Ordinance's own operative provisions and was never actually enforced in the relevant areas—so it could not validly repeal the Dastoor. It also found the Dastoor had been reclassified as a Central law in 1960, meaning a provincial law could not repeal it under Article 143 of the Constitution. On the Shariat Regulation, the court found it and the Dastoor contained mechanisms for reconciliation and Islamic adjudication consistent with constitutional requirements.
