PLD 2015 Balochistan 54 · Balochistan High Court
This case dealt with whether Pakistani courts could investigate and try a murder allegedly committed outside Pakistan's borders, near the Afghan frontier. The victim, a mechanic from Quetta, had gone to Chaman to run a garage with men who later sent his body back after he was killed with knives and screwdrivers. His brother filed a complaint, and a magistrate acting as Justice of Peace ordered police to register an FIR against the accused. The accused challenged this, arguing that since the offence occurred beyond Pakistani territory, and beyond the local police station's jurisdiction, the police had no authority to investigate without prior certification from the Federal Government or a Political Agent, as required under Section 188 of the Criminal Procedure Code.
The Balochistan High Court rejected this argument. It held that Pakistani law extends to citizens who commit offences abroad, under Sections 3 and 4 of the Pakistan Penal Code. While formal sanction under Section 188 is indeed needed before a court can "inquire into" the charge at trial, this requirement does not block the earlier step of registering an FIR or conducting a police investigation. Such sanction can be obtained later, even after the police have completed their investigation and filed a charge-sheet. Since both parties were Pakistani nationals residing in Quetta, the Court found no reason to stop the investigation and dismissed the petition, allowing the case to proceed.
