PLD 2015 Balochistan 47 · Balochistan High Court
This case involved a family property dispute in Quetta over land jointly purchased by two ancestors. The plaintiffs (petitioners) sued for a declaration that they owned specific shares of the property, wanted certain mutation entries in the revenue record cancelled, and claimed possession of their shares along with income from the property. The defendants claimed they were the sole owners.
After both sides had already presented their evidence in the trial court, the plaintiffs filed several applications, including requests to place additional documents on record and to call more witnesses. The trial court granted two minor procedural requests but refused to allow new documents and witnesses at that late stage, and also refused to strike out certain cross-examination. The plaintiffs challenged this refusal before the Balochistan High Court.
The High Court dismissed the petition, upholding the trial court's decision. It held that under the Civil Procedure Code, a party wanting to introduce late evidence or witnesses must show "good cause," and these rules are mandatory. Here, the plaintiffs had already closed their evidence without reserving any right to rebuttal, gave no real details of what they wanted to produce, and made their request only after the evidence stage was complete. The court noted such material could still be referred to and judicially noticed at final hearing.
This judgment clarifies how much discretion trial courts have to refuse late attempts to reintroduce evidence, reinforcing that procedural fairness requires timely and specific requests, not last-minute applications after evidence has closed.
