PLD 2015 Balochistan 41 · Balochistan High Court
This appeal arose from a property dispute in Gwadar. The appellant claimed he had agreed to buy about 13 acres of land from respondent No.1 in December 2004 for Rs.5,200,000, paid the full price, but the seller instead transferred the land to respondent No.2 through a mutation entry, breaching the agreement. He sued for specific performance of the contract. Since the defendants did not appear despite being served through courier and newspaper publication, the trial court proceeded ex parte and recorded the appellant's own evidence. Even so, the trial court dismissed the suit, prompting this appeal to the Balochistan High Court.
The High Court upheld the dismissal. It found that the appellant's own evidence contradicted his pleadings, particularly regarding how the property was transferred. His affidavit revealed that he himself had used a general power of attorney to transfer the land to respondent No.2, which amounted to a novation (replacement) of the original agreement. This meant he was legally stopped, or "estopped," from now claiming the original contract should be enforced, since his own actions showed he had accepted a different arrangement.
The court reaffirmed the legal principle that a party's evidence must match what was stated in the pleadings, and parties cannot introduce new facts not pleaded. Since the appellant's evidence departed from his pleaded case, the court could not rely on it to decree the suit in his favor. The appeal was therefore dismissed, reinforcing that courts strictly require consistency between pleadings and evidence in civil litigation.

ہائی کورٹ نے دعویٰ خارج کرنے کے فیصلے کو برقرار رکھا۔ عدالت نے پایا کہ اپیل کنندہ کا اپنا بیانِ شہادت اس کے دع
