PLD 2015 Balochistan 135 · Balochistan High Court

This case involved a long-running property dispute over a mosque site (Gawandan Mosooma Zainoi Durjanwal) in Kalbairak, Balochistan. After multiple rounds of litigation—including a suit, appeal, remand, another appeal, and a revision petition before the High Court—the losing parties (the petitioners) took the case to the Supreme Court, which granted leave to appeal and ordered that "status quo" be maintained while the matter remained pending. Despite this order, the winning parties later filed an execution application before the local Qazi's court to enforce the decree and take possession of the property. The petitioners objected, arguing that execution should not proceed while the Supreme Court's status quo order was in effect, but the executing court rejected their objection and ordered execution of the decree.

The petitioners then challenged that execution order before the Balochistan High Court through a revision petition. However, a threshold legal question arose: was a revision petition even the correct remedy, given that the case had been filed under the Balochistan Civil Disputes (Shariat Application) Regulation, 1976, rather than the older Dastoor-ul-Amal Diwani, Kalat, 1952? It transferred the case to the Majl
