PLD 2015 Balochistan 127 · Balochistan High Court

This case involved two applications asking the Balochistan High Court to restore constitutional petitions that had been dismissed for non-prosecution after the applicants' lawyer failed to appear in court. The lawyer explained that he had been granted leave by the Chief Justice to travel abroad for a specific period (late September to mid-October 2014) to appear as a witness in an international arbitration case in Paris, but the petitions were dismissed on 10 November 2014, after his approved leave period had already ended.

The applicants sought restoration under Section 12(2) of the Civil Procedure Code, arguing the dismissal order should be recalled. The court examined the law and found that Section 12(2) applies only to situations involving fraud, misrepresentation, or lack of jurisdiction, none of which were present here. It then considered whether it could use its general inherent powers under Section 151 CPC to restore the case, noting that such powers require the applicant to show due diligence and sufficient cause for missing the hearing.

The court found that the lawyer's approved absence had ended weeks before the actual dismissal date, meaning there was no valid explanation for the failure to appear on the day the case was actually dismissed. Concluding that the applicants had not shown sufficient cause or due diligence, and that restoring the case would serve no useful purpose, the court dismissed the restoration applications. The case illustrates how strictly courts apply the requirement of genuine justification when parties seek to reopen dismissed cases.
