PLD 2015 Balochistan 117 · Balochistan High Court
This case involved three petitions before the Balochistan High Court concerning individuals from Chaman whose Pakistani nationality status was challenged. The petitioners claimed to belong to the Noorzai tribe, settled permanently in Chaman for generations, and held Computerized National Identity Cards (CNICs) and Local Certificates. One petitioner had secured admission to Bolan Medical College (BMC) for the 2011-2012 MBBS session after passing the entry test and interview. However, a rival candidate objected that he was not a genuine local resident, leading to an FIA investigation. The FIA and NADRA authorities ultimately determined that the petitioners were actually foreign nationals (Afghans), not Pakistani citizens, and consequently cancelled or blocked their CNICs, declaring them "confirmed aliens." This affected their eligibility for local certificates and, in turn, their medical college admissions reserved for local district residents.
The petitioners challenged these findings in court, arguing procedural unfairness and disputing the alien classification.
The High Court dismissed the petitions. It held that under the Pakistan Citizenship Act, 1951, once someone is declared an alien, they cannot be treated as a citizen unless they obtain a proper domicile certificate from the Federal Government and take an oath of allegiance in the prescribed legal form. Since the petitioners had not fulfilled these requirements, the court could not declare them bona fide citizens or locals of any Pakistani district. The court also declined to interfere with the factual findings
