PLD 2014 Balochistan 96 · Balochistan High Court

This case is about a dispute between a landlord and his former tenant over commercial shops in Quetta. The landlord had earlier won an eviction case against the tenant, which was upheld all the way to the Supreme Court, and possession of the shops was handed back to him in 2004. More than a year later, the former tenant applied under section 13(4) of the Rent Restriction Ordinance, claiming the landlord had illegally re-let one of the shops to someone else instead of using it himself, and asked to be reinstated as tenant. The Rent Controller partly agreed and ordered the shop restored to the former tenant.

The landlord appealed to the Balochistan High Court. The Court found that the former tenant had not proven his case: he did not show when the alleged new tenant took possession, produced no rent agreement or reliable documentary proof, and his own witnesses did not support his claims. Instead, the landlord showed the shop occupant was actually his business partner, not a new tenant, through a partnership deed. The Court also noted the application was filed after a long, unexplained delay, which cast doubt on the claim.

The High Court set aside the Rent Controller's order and accepted the landlord's appeal, ruling that the ex-tenant had failed to meet the legal conditions required under section 13(4) to reclaim possession. The case clarifies that mere allegations of re-letting are not enough; concrete evidence of a new tenancy and timely action are required.
