PLD 2014 Balochistan 71 · Balochistan High Court
This case concerns a long-running property dispute in Balochistan. The respondents' predecessor had won a civil suit for declaration, possession, and permanent injunction against the petitioner back in 1998, and since no appeal was filed, that decree became final. When the respondents later filed an execution application in 2003 to enforce the decree, the petitioner repeatedly filed objections trying to block execution—first in 2005 (rejected), again in 2006 (dismissed for non-prosecution), and a third time, which was also dismissed. The petitioner then appealed to the District Judge, who upheld the dismissal, leading to this revision petition before the Balochistan High Court.
The High Court dismissed the petition, holding that once the first objection was rejected and not challenged, the matter attained finality, and there was no legal basis to keep filing fresh objections against the same decree. The court found the petitioner had fraudulently mutated the property in his own name and had deliberately dragged the respondents through prolonged litigation since 1991, causing them financial and emotional hardship.
Importantly, the court awarded actual litigation costs of Rs. 175,000 plus Rs. 25,000 as compensation for frivolous litigation, emphasizing that courts have discretion to make losing parties pay real costs incurred by those wrongfully forced into litigation. This case matters because it reinforces that decrees, once final, cannot be endlessly relitigated, and it signals that courts can penalize parties who abuse the legal process to delay justice.

ہائی کورٹ نے یہ درخواست خارج کر دی اور قرار دیا کہ چونکہ پہلا اعت
