Abdul Karim V. The S.H.O. Sariab Police Station Quetta and 3 others,
PLD 2014 Balochistan 50 · Balochistan High Court
This case involved Abdul Karim, who was injured during a shooting incident on land where he worked as a watchman. He wanted the police to register a separate FIR (First Information Report) telling his own version of events, but the police had already registered an FIR about the same incident describing it as a land dispute between rival groups. A trial court refused his request, reasoning that a second FIR for the same occurrence was not permissible, especially since multiple people were injured in the same firing.
Abdul Karim challenged this refusal before the Balochistan High Court. The High Court ruled that there is no absolute legal bar against registering a second FIR for the same incident when the aggrieved party gives a genuinely different account of what happened, so long as it is not merely repeating or expanding on the first version. The court found that Abdul Karim's account, that he was performing lawful duties and was attacked, differed materially from the police version portraying both sides as land-grabbing groups exchanging fire. Since this suggested a distinct criminal offense against him, the police should have registered his complaint too. The court also noted that accused persons named in a complaint have no right to be heard at the FIR registration stage.
The High Court set aside the trial court's order and sent the matter back for fresh decision, allowing the petition. This case matters because it clarifies that victims are not automatically barred from having their own version recorded, even if police have already filed a report describing the same event differently.
